Vacation Offer's 2-Night Giveaway Terms & Conditions

SPONSOR:

1. VacationOffer.Com (VO) is the sponsor of the “2-Night Getaway” promotional vacation reward (the “REWARD GIVEAWAY”) and is solely responsible for the fulfillment of all vacation vouchers properly registered.

ELIGIBILITY:

2. Registrants must be 18 years or older as of January 1, 2024.  Registrants who redeem the additional nights lodging option must be 25 years of age or older.
3. Void where prohibited by law or as otherwise determined by VacationOffer.com (VO).
4. All federal, state and local laws apply.
5. Employees, agents, successors, and assignees of VO, and their advertising agencies and promotional companies involved in this REWARD GIVEAWAY, as well as family and household members of same, shall be ineligible to participate in the REWARD GIVEAWAY and shall be ineligible for any reward covered herein.
6. By participating, you unconditionally agree to and accept these Official Rules and to the decisions of VO which are final and binding in all respects.
7. THE LISTED CHARITIES IN THIS PROMOTIONAL REWARD GIVEAWAY ARE NOT SPONSORS, AND THEREFORE, ARE IN NO WAY LIABLE FOR FULLFILLMENT OF THE COMPLIMENTARY 2-NIGHT VACATION PACKAGES OR FOR THE ACTIONS OR OMISSIONS OF VO OR ITS EMPLOYEES, AGENTS, CONTRACTORS, PROVIDERS OR OTHER THIRD PARTIES.
8. HOW TO ENTER: The REWARD GIVEAWAY shall begin October 1, 2024 and end on December 31, 2025. Eligible Participants may enter by making a donation to one of the charities listed on the website. The Participant will register for the REWARD GIVEAWAY as directed by filling in his / her required information as requested on the website: First name, last name, phone number, email address and city/state of residence are all required information and must be valid to participate and to claim the REWARD GIVEAWAY.
9. A Valid entry is defined as a delivered entry where all required information is valid, completely filled in and a donation is made to one of the listed charities. 

RESTRICTIONS:

10. One reward per Households, Couples, or groups traveling together will count as one participant. No more than the number of vacation packages set forth in these official rules will be awarded.
11. ALL POTENTIAL RECIPIENTS ARE SUBJECT TO VERIFICATION BY VO WHOSE DECISIONS ARE FINAL AND BINDING. A PARTICIPANT IS NOT ELIGIBLE TO BOOK AND TRAVEL UNTIL SAID RECIPIENT’S ELIGIBILITY HAS BEEN VERIFIED BY THE CHARITY SELECTED DURING THE REGISTRATION PROCESS.
12. No transfer, or assignment of a reward will be permitted, except VO reserves the right to substitute the reward with another reward of comparable value.
13. VO and the listed charities are not responsible for any typographical or other error.
14. REWARD GIVEAWAY recipients may be contacted via the phone number and/or email provided on original registration form to discuss travel options and recipient is required to respond within three (3) business days of the first notification.
15. If REWARD GIVEAWAY recipient(s) is/are ineligible, fails to return the notification call as required, fails to register and book the vacation voucher, or if the reward is returned as non-deliverable due to faulty registration information, recipient will be deemed ineligible and reward voucher will be forfeited or awarded to an alternate as solely determined by Sponsor.
16. By accepting a reward, recipient releases and discharges VO, and its respective affiliated companies, and the charities, from any liability or damage due in whole or in part to the award, acceptance, possession, use or misuse of any reward or from participation in this Giveaway.
17. By participating, a recipient, except where prohibited by law, grants VO, VO’s designee and their affiliated companies the right to use the winner’s name, likeness, picture, portrait, hometown, voice, biographical information and written submissions and written or oral statements, for advertising and promotional purposes without additional compensation unless required by law. 

DISQUALIFICATION / TERMINATION:

18. VO, and any other companies involved with or otherwise providing services related to this Giveaway are not responsible for lost or destroyed entries.
19. Persons found tampering with or abusing any aspect of this Giveaway, and persons entering or attempting to enter more than once, as solely determined by the Sponsor, will be disqualified. In the event any portion of this REWARD GIVEAWAY is compromised, VO reserves the right, at its sole discretion, to suspend or terminate the Giveaway. VO reserves the right, in its sole discretion, to cancel, modify, extend, or suspend the REWARD GIVEAWAY at any time.

MANDATORY ARBITRATION REQUIREMENT AND CLASS ACTION WAIVER:

20. Any controversy, claim or dispute between the parties arising out of or relating to this agreement, contest and/or promotion or the breach, termination, enforcement, interpretation, conscionability or validity thereof, including any determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Iron County, Utah in accordance with the Laws of the State of Utah.
21. The parties agree that the arbitration shall be administered by a nationally recognized arbitration service pursuant to its rules and procedures. The arbitrator shall be neutral and independent. The award rendered by the arbitrator shall be final and shall not be subject to vacation or modification.
22. Under no circumstances will a participant be permitted to obtain awards for, and participant hereby waives all rights, to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
23. Judgment on the reward made by the arbitrator may be entered in any court having jurisdiction over the parties. The parties agree that either party may bring claims against the other only in his/her or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Further, the parties agree that the arbitrator may not consolidate proceedings of more than one person’s claims, and may not otherwise preside over any form of representative or class proceeding. The parties shall share the cost (not attorneys’ fees) of arbitration equally unless otherwise required by law or the arbitration rules. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with the arbitrator’s award, the other party is entitled to costs of suit, including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award. The arbitration requirement and class waiver shall survive any termination and completion of this promotion, and the parties to it agree that it shall apply to all promotions that are related to, offered with or subsequent, by this sponsor or any subsequent promotion. In all respects, the parties expressly intend and agree to bring all claims arising or related to this promotion through binding arbitration.
24. All Participants expressly consent to be contacted via phone by VO via text or call at the phone number provided, even if it is a mobile number, using an auto dialer, regarding VO’s REWARD GIVEAWAY and their travel services.
25. By registering for this REWARD GIVEAWAY, any recipients expressly consent and request to be contacted via telephone, mobile phone, mail, email, and/or text message (standard rates apply) at the number(s) and address(es) provided by the Sponsor regarding this Giveaway, their travel services and vacation ownership products even if such number(s) have been registered on the national and/or state do not call lists.
26. All participants agree that VO, and their affiliates, and any other persons involved in the design, administration, or fulfillment of this REWARD GIVEAWAY and the charities listed (herein the “Releasees”) shall not be liable for and hereby release and agree to hold harmless each of the Releasees from liability, injury, damage, expense, cost, or loss of any kind or nature resulting from participation in this REWARD GIVEAWAY or acceptance of, receipt, use or misuse of any reward.
    

REWARD DETAILS:

27. All registrants who complete the registration process and make a donation will receive a 2-night hotel stay voucher good at the 13 destinations listed within the offer. Hotel taxes and travel not included. Blackout dates apply: July 4th, Labor day, Easter holiday, Memorial day, Spring Break, and Christmas through New Year’s.
28. 45 days advance notice required to travel.
29. All qualified registrants will be contacted by VO to be offered an extended stay option; wherein, Registrants will receive an additional night’s lodging in one of the 13 destinations being offered with no blackout dates, along with a $100 AMEX Gift Card, in exchange for attendance at a 90 minute presentation on the many benefits of vacation club membership while on vacation. Registrants to be offered the Promotional Package upgrade described in Rule 27 must meet the following additional qualifications:
    
    - Must be either Married or Cohabitating with another individual, in the same dwelling, on a permanent “full time” basis
    - Must be age 26 or older
    - Must possess a Debit Card or Major Credit Card for check-in purposes only
    - Gross household income must exceed $60,000 yearly
30. Upgraded 3-Night promotional package benefits include:
    
    - 3 Nights of accommodations at choice of 13 destinations listed
    - $100 AMEX Card included
    - Only 21 days advance notice required
    - No blackout dates
    - Refundable Deposit is required when upgrading to the 3-Night Package
    - Attendance at an informative 90-minute presentation on the many benefits of Vacation Club membership is required

LEGAL DISCLAIMERS

31. Vacation details will be provided during the first orientation phone call and confirmed via email to Traveler(s) once offer has been redeemed by Registrant.
32. All participants in this promotion agree to be bound by these Official Rules and the decisions of VO, which shall be final in all respects.
33. VO is a corporation registered with the State of Utah.
34. This advertising material is being used for the purpose of soliciting the sale of a vacation club or travel club membership.
